1. Definitions

• You / Donor: Any individual or organization using the Platform.
• We / Us / Our / Punyakart Foundation: The non-profit entity operating the platform.
• Beneficiary: NGO, trust, society, or individual running campaigns on the Platform.
• Campaign: Fundraising or donation drives hosted on the Platform.
• Materials: Items, services, or funds requested for campaigns.
• Services: Includes facilitation of donations, campaign promotion, and procurement of goods for beneficiaries.

2. Scope of Services

Punyakart Foundation bridges donors and social welfare causes like temple restoration, Gau Seva, disaster relief, and more. All donations are used transparently towards the selected causes. If a Campaign's requirement is fulfilled, Punyakart may redirect donations within similar categories as needed.

3. Eligibility

By using this platform, you confirm that you are at least 18 years old and legally eligible to enter into agreements under Indian law. Foreign donors may contribute only to campaigns compliant with FCRA regulations.

4. Campaign Verification & Beneficiary Responsibility

Beneficiaries are solely responsible for providing accurate information in their campaigns. Punyakart performs preliminary verification but is not liable for misuse or misinformation by any Beneficiary.

5. Donations and Payment Terms

• All donations made are non-refundable unless a duplicate payment or technical error occurs.
• Payments are processed via secure third-party gateways governed by their respective terms.
• Donors choosing recurring donations (monthly/yearly) agree that funds may be allocated to related causes within the selected category.

6. Tax Exemption & Compliance

Eligible donations qualify for tax benefits under Section 80G of the Income Tax Act, 1961, subject to compliance with applicable Indian laws. Tax receipts will be issued based on accurate donor details provided at the time of donation.

7. Intellectual Property

All website content, including text, graphics, logos, images, and software, is the property of Punyakart Foundation. You may not use, reproduce, or distribute this content without written permission.

8. Privacy & Data Protection

9. Disclaimer & Limitation of Liability

The Platform and its Services are provided "as is" without warranties of any kind. Punyakart Foundation is not responsible for the success of Campaigns or the specific use of donations by Beneficiaries. We are not liable for any direct or indirect damages arising from the use of the Platform.

10. Prohibited Conduct

• Do not misuse the Platform for illegal or fraudulent activities.
• Do not post false, defamatory, or harmful content.
• Do not attempt unauthorized access or disrupt the Platform.

11. Governing Law & Dispute Resolution

These Terms are governed by Indian laws. Any disputes shall be subject to the exclusive jurisdiction of the courts in Dehradun, Uttarakhand, India. Disputes will first attempt to be resolved through good-faith negotiation, failing which arbitration under the Arbitration and Conciliation Act, 1996 will apply.

12. Amendments to Terms

Punyakart Foundation reserves the right to modify these Terms at any time. Changes will be published on this page, and continued use of the Platform implies acceptance of the updated Terms.
